What is Customs Clearance?
Customs clearance is the official administrative process that governs the entry and exit of goods into and out of a country. It involves document inspection, calculation and payment of duties and taxes, and the release of goods by customs officials.
In Indonesia, customs clearance is regulated under Undang-Undang Kepabeanan No. 10 Tahun 1995, which was later amended by Undang-Undang No. 17 Tahun 2006. This makes customs clearance a mandatory step in every import and export activity involving goods entering or exiting the country.
Why is Customs Clearance Important?
Improper handling of customs clearance can result in goods being held at the port, fined, or even confiscated by authorities. Customs clearance is essential for:
- Ensuring the legality of imports or exports
- Determining tax and duty obligations
- Supporting smooth international logistics
- Ensuring compliance and security with relevant regulations
Stages of Customs Clearance
The customs clearance process in Indonesia generally consists of three main stages:
1. Pre-Clearance
This stage is completed before the goods arrive at the port. It involves:
- Registering a Business Identification Number (NIB) through the OSS system
- Arranging import licenses and permits, especially for goods classified as restricted or controlled (LARTAS)
- Selecting mode of transportation (sea or air)
- Preparing key documents such as the invoice, packing list, bill of lading or air waybill, and certificate of origin (if required)
2. Clearance
This is the main stage of customs process and begins once the goods arrive at the port:
- Receiving a Notice of Arrival (NOA) from the shipping line or airline
- Submitting the Import Declaration (PIB)
- Verifying the data and documents in the PIB
- Importer pays the duty or tax invoice
- After payment is verified, the shipment goes through the customs channelling process:
- Green Channel: Goods are released immediately
- Red Channel: Physical inspection and document verification are conducted
3. Post-Clearance
If goods go through the red channel and a detailed inspection is conducted, the outcome could be:
- An SPTNP (Surat Penetapan Tarif dan/atau Nilai Pabean), which must be paid first
- Or directly receiving an SPPB (Surat Persetujuan Pengeluaran Barang)
Once all requirements are fulfilled and the SPPB is issued, the goods can be released from the port.
Key Documents Required for Customs Clearance
The following documents are commonly required during the process:
- Commercial Invoice
- Packing List
- Bill of Lading or Airway Bill
- Certificate of Origin (if applicable)
- Import License or NIB
- Insurance and Letter of Credit (if applicable)
Common Challenges in Customs Clearance
Some frequent issues that arise during customs clearance include:
- Incomplete or inaccurate documentation
- Incorrect valuation of goods
- Goods subject to restrictions or special regulations
- Wrong use of HS Code
- Mismatch between physical goods and documentation
These issues can cause delays, penalties, or even rejection of goods entry.
